A Nigerian court has granted Dangote Refinery an interim injunction preventing NNPCL and regulators from halting crude and gas supplies, citing risks to the economy and essential services.
A legal dispute has emerged between Dangote Refinery and major stakeholders in Nigeria’s petroleum industry, including the Nigeria National Petroleum Company Ltd (NNPCL). On Monday, Justice Emmanuel Danjuma Subilim granted an interim injunction in favor of Dangote Refinery, restraining the defendants from halting crude oil and gas supplies to the facility.
Court Order and Legal Arguments
The injunction, which followed an ex-parte application filed by Dangote Refinery, specifically restrains NNPCL, the Nigeria Midstream and Downstream Petroleum Authority, and the Nigeria Upstream Petroleum Regulatory Commission from disrupting operations.
Representing Dangote, George Ibrahim (SAN) argued that any disruption in crude and gas supply would cripple the refinery’s operations and have a negative impact on the Nigerian economy.
The application also raised concerns about a potential industrial action allegedly instigated by the first defendant, linked to a recent reorganization at the refinery that resulted in staff layoffs. Dangote’s counsel maintained that the planned action violated Nigerian labor laws, as there had been no prior engagement or dispute resolution process.
Court’s Ruling
In his ruling, Justice Subilim stressed the importance of maintaining industrial peace and ensuring the continued provision of essential services to Nigerians. He noted that the balance of convenience favored Dangote Refinery, as a strike or supply disruption would cause irreparable damage to its business and disrupt critical energy services.
The restraining order will remain in effect for seven days, with a hearing for the Motion on Notice scheduled for October 13.
