Key provisions of the order include:
– A prohibition on the sale, leasing, or mortgaging of the specified properties until the imminent determination of the case.
– Authorization for the applicant to mark the contested property with red paint, accompanied by signs stating “NOT FOR SALE / Lis Pendens.”
– Requirements for the applicant to publicly display the court order at the property and in national newspapers.
Justice Madugu further underscored the necessity of maintaining the status quo, cautioning the parties involved against any changes to the property or removal of the court signage, as such actions would constitute contempt of court.
The case arises from allegations presented by Eniyamire, who claims she was unjustly treated in the execution of her father’s will, which she contends delineated an asset division among his family based on an 11.11 percent formula. Eniyamire contends that Awolumate misrepresented this formula to the detriment of her inheritance.
