MultiChoice vs. FCCPC: Judgment Imminent.

The Federal High Court in Abuja has set May 8th as the judgment date in the case between MultiChoice Nigeria Limited and the Federal Competition and Consumer Protection Commission (FCCPC). Justice James Kolawole Omotosho scheduled the decision following the adoption of written arguments by both parties.

The suit concerns the FCCPC’s authority to regulate MultiChoice’s pricing of DStv and GOtv services. MultiChoice argues that the FCCPC Act does not grant the commission the power to control prices, while the FCCPC contends that its mandate includes preventing exploitative pricing and addressing abuse of dominant market positions. The court previously issued a restraining order against the FCCPC, preventing administrative action against MultiChoice pending the final verdict. The judgment will clarify the extent of the FCCPC’s regulatory powers in relation to pricing practices within dominant market sectors.
